The presentation, “Sub V vs. Traditional 11? Confirmation and Other Key Plan Issues,” was co-presented along with Hon. Janet S. Baer, U.S. Bankruptcy Court (N.D. Ill.), Chicago, IL; Eyal Berger, Akerman LLP, Fort Lauderdale, FL; Brandy M. Rapp, Whiteford, Taylor & Preston LLP, Roanoke, VA; and Donald L. Swanson, Koley Jessen, Omaha, NE

This panel explored plan-confirmation considerations for chapter 11 debtors in small business cases compared to those debtors that have elected to proceed under subchapter V, with a focus on comparing the cramdown requirements and select plan-confirmation issues.

Waldrep Wall Babcock & Bailey PLLC is excited to announce that Kylie L. Hamilton has joined our firm as our newest Associate. Kylie brings with her a strong background in business insolvency and commercial bankruptcy law.

Kylie joined Waldrep Wall Babcock & Bailey PLLC as an Associate in 2024. She received her Bachelor of Arts degree in Business Management and History from Alma College in Alma, Michigan, graduating Magna Cum Laude in April 2017. Kylie earned her Juris Doctor degree from Wake Forest University School of Law in 2020. While attending, she was a member of the Manuscripts Committee for the Wake Forest Journal of Law & Policy, participated in the Veterans Legal Clinic and was an executive board member for the Pro Bono Society and Public Interest Law Organization (PILO).

Partner Ciara L. Rogers To Participate as Moderator During a Trustee Connect Webinar Through the NABT

Waldrep Wall Babcock & Bailey PLLC Attorney Ciara L. Rogers will be participating as the moderator during a Trustee Connect Webinar through the National Association of Bankruptcy Trustees (NABT) titled, “A Roadmap to Pre-packaging a Chapter 11 Plan in Subchapter V,” on March 29, 2024 from 12pm to 1pm ET.

The panel of speakers will include The Honorable Paul Bonapfel, US Bankruptcy Court, NDGA; Eyal Berger, Akerman LLP; and Samuel Dawidowicz, Quest Turnaround Advisors.

The program will highlight the benefits and potential consequences of pre-packaging a Chapter 11 Plan in Subchapter V. The program will also identify certain unique Subchapter V issues that relate to expediting the confirmation of a pre-packaged Subchapter V Plan and potential solutions to same.

On March 19, our firm co-hosted an event with Highwoods Properties, Inc. in the main lobby of our Raleigh office. Highwoods held a meet and greet for the building’s new property manager and brought the coffee, while Waldrep Wall Babcock & Bailey supported the Legal Feeding Frenzy by collecting canned food donations and brought the donuts. The Legal Feeding Frenzy is an opportunity for the legal community to come together to make a difference in the fight against hunger.

4ALL Statewide Service Day is an annual call-a-lawyer pro bono program that engages hundreds of volunteer attorneys to provide free legal information to thousands of North Carolinians, from the mountains to the coast. 4ALL is the North Carolina Bar Foundation’s largest annual pro bono program. Each spring, Waldrep Wall Babcock & Bailey PLLC lawyers join forces to provide advice, information, and resources to callers seeking information regarding North Carolina-related legal matters.
