Waldrep Wall Babcock & Bailey PLLC Partner Tom Waldrep, along with another former Bankruptcy Judge, Melanie L. Cyganowski, and Professor Nancy B. Rapoport, recently submitted an amici curiae brief to the Fourth Circuit Court of Appeals in the Kaiser Gypsum case on the issue of whether an insurer whose legally protected interests are not affected by a Chapter 11 plan of reorganization is nevertheless a “party in interest” entitled to raise “any issue” in that case under 11 U.S.C. § 1109(b).
