Bio
For more than two decades and in forums across the country, Kelly has been engaged in protecting his clients’ most valuable assets and resolving their most challenging issues. A large part of Kelly’s practice has been devoted to safeguarding his clients’ intellectual property and trade secrets and resolving disputes involving noncompetition and non-solicitation agreements, unfair competition claims, and claims arising under the federal Computer Fraud and Abuse Act for local, regional, and international companies ranging in size from start-ups to publicly traded, Fortune 100® firms. In addition to employment and business tort litigation, Kelly routinely represents clients in defending and resolving complex, multi-party commercial matters, regulated investment advisor and broker litigation, and bankruptcy-related litigation.
On a pro bono basis, Kelly has been involved in civil rights and constitutional litigation and international child abduction litigation under the Hague Convention in federal District Courts, the United States Courts of Appeal, and the United States Supreme Court.
Kelly is licensed to practice in Maryland, the District of Columbia, and North Carolina. Prior to moving to North Carolina, Kelly spent more than two decades in the commercial litigation and intellectual property groups at Perkins Coie in both Washington, D.C. and Idaho, where he served as the managing partner of that firm’s Boise office. In Winston-Salem, Kelly was a partner at Wall Babcock LLP before joining Waldrep Wall Babcock & Bailey PLLC.

- Represented a North Carolina business in litigation under North Carolina’s Abusive Patent Assertions Act, successfully defending the constitutionality of the statute and obtaining a federal court ruling declaring the asserted patent invalid.
- Represented a Litigation Trustee in bankruptcy adversary proceedings arising from an alleged
fraudulent laboratory billing scheme involving affiliated rural hospitals, resulting in the recovery
of nearly $10 million. - Represented a regional hospital system in a bankruptcy adversary proceeding brought by a
Litigation Trustee, securing a confidential resolution prior to trial. - Represented a Swiss-based technology company in the defense of employment and breach of
contract claims, conducting international discovery and securing a confidential resolution prior
to trial. - Represented a national broadcasting company in federal litigation involving trade secret
misappropriation, Computer Fraud and Abuse Act claims, breach of contract, and related
business torts, resolving the matter after extensive discovery. - Obtained summary judgment on behalf of a national home improvement franchisor, securing
dismissal of all claims asserted by former franchisees in federal court. - Represented telecommunications providers in regulatory proceedings, arbitrations, and federal
litigation throughout a 14-state region involving implementation of the Telecommunications Act
of 1996. - Served on the legal team representing the petitioner in Hamdan v. Rumsfeld, a landmark case
litigated before the United States District Court, the D.C. Circuit, and the United States Supreme
Court. - Represented international clients in Hague Convention child abduction proceedings before
federal district courts, federal courts of appeal, and the United States Supreme Court.
